Corporate law Coursework Example | Topics and Well Written Essays - 7500 words
Corporate law - Coursework Example The announcement confronted disparate reactions. Some applauded the government's plans, while others stringently opposed them, questioning the very need for the adoption of a corporate manslaughter bill. A third group maintained the exigencies of designing and passing into legislature a corporate manslaughter bill but voiced doubt over the proposed bill's capacity to address the problem. The imperatives of bestowing legal recognition upon corporate manslaughter, on holding corporate entities criminally liable for acts/cases of unintentional manslaughter, and the capacity of the proposed bill to effectively address the defined problem, comprise some of the dissertation's core concerns. Since the 1980s many companies in the U.K. ... 1.1 Research Background Since the 1980s many companies in the U.K. have been exposed to charges of corporate manslaughter - many disasters and incidents of death involving corporations such as Piper Alpha explosion, Hillsborough Stadium disaster, the capsize of the Herald of Free Enterprise etc., which were initially deemed and labelled as tragic 'accidents,' at the most attributable to the unlawful action of individuals, were later proved to be more a result of corporate malfeasance than individual offence.1 But, for various reasons including the absence of an appropriate law for tackling the offence; the application of flawed criminal law doctrines, ill-suited to corporate criminality; the absence of judicial and political commitment etc, in almost all the major cases, the criminal charges against the corporations failed at the prosecution stage itself. Beyond effective social and legal control, large and powerful corporations continue to inflict severe harm to society through negligent and/or reckless la w breaking. The rising public consternation about the consequences of corporate negligence and the persistent call for appropriate criminal justice intervention for effectively tackling corporate malfeasance has received significant impetus from the government during the past decade, as new and more effective steps for prosecuting companies are explored - the introduction of the new and separate offence of "corporate killing" and the introduction of draft Corporate Manslaughter Bill in 2005 may be considered as major steps in this direction. Nonetheless, the lack of urgency demonstrated by the British Government in enacting into law the 'corporate killing' offence is appalling - first

Health reform (research paper) - Essay Example to ensure customer satisfaction and preferences, to focus on value between providers and insurers, and to minimize the burden on tax payers (Haislmaier 2006). The major aspect of the Massachusetts legislation is the conception of the Connector ââ¬â a statewide health insurance. Connector will act as a ââ¬Å"private sate-government chartered (Haislmaier 2006)â⬠one-stop shop ort office where individuals and business employers who have employees numbering from fifty (50) and below will be capable to pay for personal and transferable health insurance coverage (Haislmaier 2006). Underinsurance is a major concern for Massachusetts residences since some individuals will prefers to purchase health plans that entails high cost of sharing to be able to bring lower premiums monthly; and restricted benefits (Long 2008). These factors causes higher health care costs per person and can be the reason why most will choose to go without some benefits of a health care plan just to avoid excess health care expenses (Long 2008). Hence when this happens, workers who earn high salaries are covered for any serious injury or illness; while moderate and low income earners will encounter difficulties if the fee for the care which they will need will exceed the coverage of their chosen health insurance plan (Long 2008). The health reform in Massachusetts paved way to having a low rate of universal individuals during its first year of execution. This likewise involved reduction of financial expenses in acquiring health care and enhancement of access to it (Long 2008). Issues surrounding the provisions of the health reform in Massachusetts are concentrated on two aspects which are: that Massachusetts residents must buy a health insurance, and business that have more than ten (10) employees or personnel which do not provide their workers any health insurance should make payments to the stateââ¬â¢s compensated care pool for a per worker contribution scale (Haislmaier, 2006). ART - Essay Example Foster, Krauss, Bois, and Buchloh focuses on a crucial eventââ¬âhow the seminal work is created, how the artistic manifesto is published and the opening of a major exhibition; this crucial event tells us the story of enchanting diversity of practice and interpretation that characterizes the art of the twentieth century. Nevertheless, they made a point to explain in detail all the turning points and breakthroughs of modernism and postmodernism. 1. Modernism is generally an artistic approach, which dominated the European and American art and literature in the Twentieth Century. The key features of modernism are thought to be the principles of formalism and the autonomy of art. 3. The third aspect is the concept of the avant-garde, which challenges the dominant artistic culture. Often referred to as "inner logic of modernism", this critical force makes the art move forward towards Postmodernism. Characterized as a critique of Modernism and the project of modernity, Postmodernism is best understood as a part of a cultural shift which has been felt in science, philosophy, and the arts. Culture is seen by others (e.g. Jean Baudrillard) as an endless play of imitation (simulation) which signals the end of authenticity and reality and the emergence of "hyperreality" (Baudrillard 1049-50) 2. Interventionist is when the artist becomes a manipulator of signs rather than a producer of Art. The viewer becomes "an active reader of messages rather than a passive contemplator of the aesthetic"(Foster 1066). This form of Art is described as "a social sign entangled with other signs in systems productive of value, power and prestige" (Foster 1066) This critique of Modernity often takes the form of a challenge to the norms and values of western culture as a whole. But this critique is losing its popularity. If we still donââ¬â¢t have an answer to Hal Fosterââ¬â¢s 1996 question, ââ¬Å"Whatever Happened to
